General Terms and Conditions

§1: General

Orders placed by private or commercial customers with the Sport-Tiedje GmbH are subject to these general terms and conditions. The Sport-Tiedje GmbH, Flensburger Str. 55, D-24837 Schleswig, is the contracting party. Contradictory or conflicting conditions of the customer will not be accepted or acknowledged; this applies even if Sport-Tiedje carry out deliveries without reservation in full knowledge of conflicting conditions of the customer.

§2: Conclusion of Contract

When placing an order, the customer makes Sport-Tiedje an offer regarding the completion of a contract. The receipt of the order is confirmed by an automated email. This email does not indicate whether the offer has been accepted. The acceptance of the offer is confirmed and the sales contract valid upon the receipt of another email, the sales confirmation, or the dispatch of the ordered goods. The contract text is stored by Sport-Tiedje. The user can look at, save or print the terms and conditions on Sport-Tiedje's website.

A window showing all the information entered by the customer will appear before the order is sent off. Typing errors can be corrected using the "change" button.

The contract can be concluded in German, Danish, English, Finnish, French, Italian, Dutch, Norwegian, Spanish or Swedish.

§3: Prices

All prices listed include the statutory VAT. The prices from the date the order was placed apply. The product information shows the VAT rate applied. Sport-Tiedje deliver to the countries listed below solely those products listed in the respective online shop, determined by the website address, at the prices stated on the respective website. The costs incurred for the delivery to these countries are shown in the online shop, during the order process and are confirmed when the customer receives the order confirmation.

Delivery to Norway and Russia is tax-free. Please note that, in this instance, there will be additional tax and customs charges upon delivery which Sport-Tiedje have no influence on. The payment of these fees is the customer's responsibility.

§4: Dispatch

Small goods are sent by DHL, UPS, FedEx or DPD. Large, heavy or bulky orders are sent by freight carrier. Transport insurance is included in principle. The parcel service delivers beyond the apartment door, the freight carrier beyond the first lockable, ground-level door (e.g. not to the cellar, attic or other rooms).

§5: Right of Withdrawal

End-consumers from the EU, as well as Switzerland and Norway, have a 14-day right of withdrawal. This right of withdrawal neither applies to commercial customers nor deliveries outside the EU, Switzerland and Norway.

The right of withdrawal does not apply to distance contracts

• for the delivery of goods which are custom-made or
• clearly tailored to the needs of the customer or
• not suitable for sending back due to their nature or
• have expired orr
• the delivery of audio or video recordings or software if the customer has unsealed the supplied media.

§6: Agreement for the Coverage of the Costs in Case of a Withdrawal

Exercising the right of withdrawal, end-consumers always have to cover the cost of returning the goods if the goods received are those ordered. In any other case, the return of the goods is free of charge.

Germany: As an exception to this, the customer always has to cover the costs of returns from Germany if the costs of returning the goods provided the goods received are those ordered and if the value of the returned goods does not exceed 40EUR or the customer has not paid the full amount or the installment as per contract, even if the value of the good(s) does exceed 40EUR. In any other case the return is free of charge for the customer.

Finland: Returns from Finnland are always free if the goods can be returned by post.

§7: Warranty

The customer's warranty rights comply with general statutory provisions.

The period of limitation for warranty claims for private customers is 2 years. Damage in transit has to be reported to the freight carrier upon receipt of the goods. Sport-Tiedje ask customers to report concealed damage to them within 5 working days. However, failing to do this will not affect the customer's statutory rights providing you have ordered as a consumer for private use.

The period of limitation for warranty claims for commercial customers is 1 year. Furthermore, the inspection and reprimand obligation in accordance with §377 HGB (German Code of Commercial Law) applies.

§8: Reservation of Proprietary Rights

The delivered goods remain property of the Sport-Tiedje GmbH until paid for in full.

§9: Partial Nullity

Should individual provisions of the contract for delivery or of these terms and conditions become void, the remaining provisions shall not be affected.

§10: Applicable Law

The law of the Federal Republic of Germany under exclusion of the UN Convention on Contracts for the International Sale of Goods applies to contracts with the Sport-Tiedje GmbH.

If the customer is a registered merchant, a legal person or a public institution (having no legal capacity), the competent court is declared at Sport-Tiedje's company headquarters. The place of performance is Schleswig. This does not apply to private customers.
